Manslaughter is a lesser offense than felony murder. Wisconsin's statutes do not include the crime of manslaughter. When the criminal code was rewritten, the crime of manslaughter was removed. In its stead, the legislature enacted second degree intentional homicide. Second degree intentional homicide nearly provides the same offense as manslaughter provided previously, but with less specificity, and with harsher penalties. Second degree intentional homicide is defined as the taking of the life of another with intent to kill or cause serious bodily injury. Second degree intentional homicide is a Class B felony. Second degree intentional homicide is charged when an intentional homicide occurs under mitigating circumstances, or when the prosecuting attorney concedes that he cannot prove the elements of first degree intentional homicide.
